Occupational Health & Safety And Injury Management

All employers in all States and Territories have a legal obligation to comply with Occupational Health & Safety (OH&S) and Workers Compensation Laws. With respect to OH&S, most States and Territories have now introduced positive obligations for employers to:

| | Identify workplace hazards;
|
| | Assess risks arising from these hazards; and

In most States and Territories Workers Compensation Laws require employers to provide first aid facilities, to keep records (including an Injury Register), to notify injuries in accordance with strictly legislated guidelines and to have a documented Return-to-Work Program which includes the provision of “suitable duties”.
The penalties for non-compliance are heavy (in NSW up to $1.65 million for a corporation and $165,000 and/or 5 years imprisonment for an individual). Yet, despite the best of intentions, many businesses simply do not have the resources required to track their way through the system to determine exactly what they should be doing to meet their legal obligations.
